Alphanet has the necessary administrative authorisation to carry out its activities, in accordance with Order INT/314/2011 of 1 February on private security companies. The authorisation details are D.G.S.C. 07/2009 and the body responsible for supervising this authorisation is the Department of the Interior of Spain.
Purpose of the website
The purpose of the website is to provide users with:
- All information relating to Alphanet’s services and activities;
- General information on the protection of personal data that Alphanet makes available to its users through a blog (hereinafter, the ‘Blog’) which will contain:
- Information on rights and obligations regarding personal data protection; and
- Access to the service for requests regarding personal data protection regulations.
Access and use of the website
This Legal Notice regulates access to and use of the Website. Access to and use of the Website by users implies acceptance of this Legal Notice, as well as its Privacy and Cookies Policy.
Alphanet reserves the right to revise this Legal Notice at any time for legal or technical reasons, or due to changes in the provision of the Website or in regulations, as well as modifications that may arise from applicable codes or, where applicable, strategic corporate decisions.
User responsibilities
As a condition for accessing and using the Website, as well as the Blog request service described in the previous clause, the user acknowledges and accepts that:
- Access to and use of the Website is subject at all times to compliance with this Legal Notice;
- Access to and use of the Website is solely and exclusively for the purposes set out in section 2 of this Legal Notice; and y
- You will make responsible and reasonable use of the Website and its contents, in accordance with the possibilities and purposes for which they are respectively designed.
Terms of use
It is expressly prohibited:
- Using any of the content and services for illegal purposes or effects, prohibited in this Legal Notice and other applicable conditions, harmful to the rights and interests of third parties, or that in any way may damage, disable, overload, deteriorate or impede the normal use of the Website;
- Using content and services that are protected by any intellectual or industrial property rights belonging to Alphanet or third parties, without the user having previously obtained the necessary authorisation from their owners to carry out the use they are making or intend to make;
- Reproducing, copying, distributing, communicating, transforming or modifying the contents of the Website, unless authorised by Alphanet;
- Incorporate viruses or other physical or electronic elements that may damage or impede the normal functioning of the Website, as well as the network, system or computer equipment (software and hardware) of Alphanet or third parties, or that may damage the electronic documents and files stored on said computer equipment;
- Submitting or contributing any content, comment or opinion that may be considered defamatory, racist, sexist, xenophobic, discriminatory, pornographic, violent or that in any way is contrary to morality, public order or good customs, or is clearly unlawful or illegal;
- Interfere with or manipulate any rating system or user response system; and
- Submit or provide any information or comments about another person without that person’s permission.
The user shall be liable for any damages of any kind that Alphanet may suffer as a result of the breach of any of the obligations to which they are subject under this Legal Notice or applicable legislation.
Likewise, Alphanet may check, moderate, reject or delete any content included in the Blog if it considers that it breaches any or all of the rules of use in this clause.
Failure to comply with any or all of the rules of use included in this clause constitutes a breach of this Legal Notice, giving Alphanet the right to take all or some of the following actions (with or without prior notice):
- Immediate, temporary or permanent withdrawal of the user’s right to use the Website;
- Immediate, temporary or permanent removal of any user content;
- Issuing a warning to the user;
- Taking legal action against the user, including proceedings for reimbursement of all costs (including, but not limited to, reasonable administrative and legal expenses) resulting from the infringement; and
- Disclosure of this information to the competent law enforcement and judicial authorities.
Limitation of liability
Alphanet makes its website available to users, assuming sole and exclusive responsibility for the diligence that may be required by law. Therefore,
Alphanet shall not assume any responsibility, whether direct or indirect, arising from the misuse or fraudulent or illegal use made by users of the website or the content hosted therein.
Alphanet will make every reasonable effort to monitor the legality of comments, opinions and other information communicated through the Blog. However, as it is not possible to exercise absolute control over these, the user shall be solely responsible for the information, comments, opinions, references or content of any kind that is communicated, hosted, transmitted, made available or displayed through the Blog.
Alphanet may limit the publication on the Blog of content, opinions, information or comments submitted by Alphanet users, applying filters for this purpose if it deems it appropriate. This does not imply, in any way, an obligation on the part of Alphanet to control the content that may be disseminated through the Blog, but rather the desire to avoid, as far as possible, the dissemination through the Blog of content, comments or opinions that may be considered defamatory, racist, sexist, xenophobic, discriminatory, pornographic, violent or in any way contrary to morality, public order or good customs, or that are clearly unlawful or illegal, in accordance with the rules of use included in the previous clause.
Alphanet will use all reasonable efforts and means to ensure that the Website is available, although it does not guarantee the absence of interruptions or errors in access to the Website, nor does it assume any responsibility for technical problems or failures that may occur during the user’s Internet connection. Similarly, under no circumstances will Alphanet be liable for:
- Problems with access, availability and/or continuity of the Website that allow access to it via a mobile device and/or its integrated features, when these problems arise from factors beyond the control and activity of Alphanet. For example, and without limitation, the device used by the user, the available bandwidth, the Internet connection speed or the geographical location;
- Damages or losses of any kind that may be caused by the interruption, termination or malfunction of the Website for reasons not attributable to Alphanet; and
- The existence of viruses or other elements that may cause alterations to the user’s computer system and/or mobile device. Alphanet is not liable for any damage and/or harm to the user’s software and/or hardware arising from access to and/or use of the Website.
Use of links
- The use of any technical, logical or technological resources by which anyone, whether a user of the website or not, may benefit, directly or indirectly, with or without profit, from the contents of the website is prohibited.
- No one may insert on their website, blog, forum or any other social network a link, hyperlink or similar link that redirects to the website or other URLs containing Alphanet content. If Alphanet detects any link of this nature, it shall be fully entitled to take action to remove this link and, where appropriate, bring it to the attention of the competent authorities; and
- Third-party links: The user acknowledges and accepts that Alphanet is not responsible for the accuracy or availability of the information, material or content included on third-party websites. Nor is it responsible for the content, operation, conditions of use or privacy policies of these third-party websites.
Intellectual and industrial property
The contents of the Website, including texts, images, graphic design, source code, logos, trademarks, etc., are the exclusive property of Alphanet, except for content provided by third-party collaborators, and therefore their reproduction, modification, distribution or manipulation is prohibited.
Alphanet is the exclusive owner of all intellectual, industrial and similar property rights that may apply to the website, including, but not limited to:
- Those elements that make up the visual appearance, graphic image and other sensory stimuli of the Website;
- The navigation architecture;
- The source code;
- Images;
- Technology; and
- Logos and other distinctive signs.
Use of the Website shall not be construed as a licence or right to use Alphanet’s trademarks, names, logos, images or trade names. Use of the Website to download, copy or reproduce its content shall not constitute a transfer of any rights to the software or content of the Website.
Unauthorised use, as well as any damage caused to Alphanet’s intellectual and industrial property rights, may give rise to the exercise of the corresponding legal actions and any liabilities that may arise from them.

Nullity
If any of the clauses of the Legal Notice is declared, in whole or in part, null and void or ineffective, such declaration shall only affect that provision or part thereof that is null and void or ineffective, with all other provisions remaining in force.
Language
Users may consult this Legal Notice in several languages at any time by clicking on the corresponding section of the Website.
However, users declare that they are aware and accept that in the event of any contradiction between the different translated versions of this Legal Notice made available by Alphanet, the Catalan version shall prevail.
Applicable legislation and jurisdiction
- The user declares that they are aware and accept that Alphanet is subject to Spanish law; and
- The user is aware and accepts that this Legal Notice shall be governed by Spanish law, and any dispute shall be settled by the Courts of Barcelona, except in cases where a legal provision establishes another jurisdiction in favour of the user.
